Our Chapter 13 Bankruptcy Practice

In a Chapter 13 bankruptcy proceeding, you are allowed to restructure your debts, entering into new promises to repay your creditors over a 3 to 5 year period. In return, your creditors are prohibited from calling, sending you letters, or taking legal action to collect on the debt.

We handle all matters associated with Chapter 13 bankruptcy filings, preparing and submitting all documentation to complete the process, and acting as your advocate in meetings with creditors or the trustee, or hearings in the bankruptcy court. We will help you put together a reorganization plan to submit to your creditors, and will review any proposed repayment plans you receive from creditors, to ensure they are within your means. If you make a new promise to repay debt under Chapter 13 and fail to keep your promise, you can lose the protection afforded by the bankruptcy laws.

If you are paying for a house and have two mortgages, we can often use a Chapter 13 bankruptcy proceeding to separate at least one of the liens from the property, reducing the risk that you will lose your home. This process, known as lien stripping, is difficult. It is essential that you have an experienced lawyer help you with the process.
