Our Home Mortgage Foreclosure Defense Practice
We provide strong and assertive counsel to homeowners facing potential foreclosure on their mortgage, using a wide range of legal strategies to protect your interests, including:
- Home loan modifications. We will work directly with your lender to try to negotiate new terms for your loan that make it more affordable, including a reduction in the interest rate and/or an increase in the term of the loan. We will also attempt to have your bank or mortgage company either waive penalties and fees or allow you to finance past due amounts.
- Chapter 7 or Chapter 13 bankruptcy filings. When you file for bankruptcy protection, your lender must stop all legal actions involving your home until the bankruptcy is final. This can buy you the time you need to either refinance or get caught up. While you cannot discharge your home mortgage obligation under Chapter 7, you can get rid of other unsecured debt that can make it possible for you to make your mortgage payments.
- Truth-in-Lending Act challenges. We will look closely at how your mortgage was obtained to see if your lender violated state or federal laws. If so, we will seek the dismissal of the foreclosure action.
